Why this Philadelphia court holds the keys to American corporate law
In short: Based in Philadelphia, the Third Circuit handles a disproportionate amount of the nation's most influential commercial litigation. Because it oversees Delaware, where more than half of all publicly traded U.S. companies are incorporated, the decisions made by its 14 active judges carry immense weight for the global economy.
The Third Circuit United States Court of Appeals exercises appellate authority across several distinct areas. Its reach includes the districts of New Jersey, Pennsylvania, and Delaware, as well as the District Court of the Virgin Islands. Notably, the Virgin Islands court is an Article IV territorial court rather than an Article III district court.
The court's administrative structure follows a unique rotational system. Unlike the Supreme Court, which has a specifically nominated Chief Justice, the position of chief judge among the Third Circuit's 14 active judges rotates. To qualify for this leadership role, a judge must have served actively for at least one year and be under the age of 65. The vacancy is filled by the most senior qualified judge, with seniority determined by commission date and then by age.
A seven-year term is served by the chief judge, unless they turn 70 sooner. While the office of chief judge carries administrative responsibilities and the judge presides over their assigned panels, the individual may resign the leadership role while maintaining their active status as a circuit judge. The current regulatory framework for these positions has been in effect since October 1, 1982.
The court's main headquarters is located within the James A. Byrne United States Courthouse in Philadelphia. Beyond its primary location, the court conducts sittings in other venues, such as the United States Virgin Islands, to fulfill its judicial duties.
