The only Best Picture nominee that vanished from history, leaving only fragments behind
In short: Ernst Lubitsch’s 1928 film The Patriot was a critical triumph, earning an Academy Award for Best Writing and a Best Picture nomination. Yet, today, it is a ghost. No complete copy exists, leaving only scattered reels and trailers to hint at the grandeur of this lost cinematic masterpiece.
Released by Paramount Pictures, The Patriot was a pioneering part-talkie, marking the studio’s first feature to include spoken dialogue alongside synchronized music and sound effects. Directed by Ernst Lubitsch and starring Emil Jannings, Florence Vidor, and Lewis Stone, the film dramatized the erratic, paranoid reign of Tsar Paul I of Russia. It was adapted by Hanns Kräly from plays by Dmitry Merezhkovsky and Ashley Dukes, the latter of which notably served as the Broadway debut for John Gielgud in January 1928.
The narrative follows Count Pahlen, a man torn between his duty to a tyrannical emperor and his love for Countess Ostermann. As Pahlen orchestrates a conspiracy to remove the Tsar, the film explores themes of betrayal and sacrifice. The climax sees the Tsar assassinated by a soldier named Stephan, followed by Pahlen’s own death at the hands of the same man, ending with the titular declaration that he acted as a patriot despite his personal failings. The film’s technical ambition was matched by its awards success, securing nominations for Best Director, Best Actor, and Best Art Direction.
Despite its prestige, the film has suffered a tragic fate. It remains the only Best Picture nominee for which no complete or near-complete print has ever been recovered. Of the original 10,000 feet of film, only about 2,500 feet remain in the possession of the UCLA Film and Television Archive, with another single reel discovered in Portugal. While a French remake was produced in 1938, the original 1928 version exists only in pieces, a haunting reminder of the fragility of early film history and the silent disappearance of a once-celebrated work of art.
