The legal friction between national sovereignty and international justice
In short: When a global court issues warrants against a nation's leaders, the response can trigger a cascade of personal and geopolitical consequences. Executive Order 14203 illustrates how high-level sanctions can move from abstract policy to paralyzing personal restrictions for the individuals tasked with upholding international law.
Signed on February 6, 2025, Executive Order 14203 imposes sanctions on the International Criminal Court (ICC) in response to its investigations into U.S. citizens and allies. The order, which includes visa restrictions and financial penalties, was widely perceived as a direct reaction to the ICC's November 2024 arrest warrants for Israeli Prime Minister Benjamin Netanyahu and former Defense Minister Yoav Gallant. The U.S. The government labelled the ICC a 'national security threat' and a 'bankrupt institution' which conducts 'lawfare' targeting Israel and the United States.
The order has been used to target specific individuals, including ICC prosecutor Karim Khan and several judges. By June 2025, Secretary of State Marco Rubio announced sanctions against four judges—Beti Hohler, Reine Alapini-Gansou, Luz del Carmen Ibáñez Carranza, and Solome Bossa—for their roles in these investigations. Subsequent actions in July and August 2025 expanded the list to include Francesca Albanese and four additional judges, including Kimberly Prost. The administration also designated several human rights centers in September 2025.
These sanctions have sparked significant international backlash. The International Bar Association denounced the moves as politically motivated interference that undermines the international rules-based order. Similarly, the Dutch government and the European Council expressed regret and concern, labeling the order a threat to the independence of international judicial institutions. For the sanctioned judges, the impact is tangible: Kimberly Prost reported that the sanctions caused immediate bank account freezes, the loss of online shopping capabilities, and the revocation of visas for family members, describing the cumulative effect as 'paralysing.'
