The impossible balance of expert testimony in family courts

Expert Witnesses: a Zero-sum Game? - Professor Jo Delahunty QC · 58:12 · Video: Gresham College · Watch at the source

In short: When a child's life hangs in the balance, who holds the ultimate authority? Courts must navigate a minefield where medical expertise clashes with parental rights. It is a high-stakes tug-of-war between protecting vulnerable children from abuse and preserving the fundamental bond between parents and their offspring.

The family court operates under a paramount mandate: the welfare of the child must be the primary consideration in every decision. However, determining what constitutes 'best interests' is an immense complexity that often requires weighing conflicting types of authority. On one side sits the medical establishment, providing evidence-based guidance on vaccinations, experimental treatments, and end-of-life care. On the other side are parents who may reject conventional medicine in favor of holistic alternatives or seek out specialized treatments abroad.

These conflicts frequently manifest as emergency applications under various legal frameworks, such as wardship or Section 31 of the Children Act 1989. The court must decide when to intervene—for instance, whether to arrest parents and remove a child from their care to pursue life-saving radiotherapy against their wishes, or to allow them to continue a journey toward a treatment they believe is superior. These cases highlight a systemic tension: while the law gives 'very great weight' to parental wishes, those wishes remain legally subordinate to the child's welfare.

The role of the expert witness in these scenarios is not merely to provide facts but to inform a zero-sum moral calculation. The court must balance the risk of a child suffering abuse or medical neglect against the 'gross injustice' of wrongly removing a child from their home based on an expert opinion that may be flawed. It is a delicate judicial balancing act where the goal is to ensure that neither the state nor the parents overstep, but rather that the child's safety remains the only constant.

This discourse was highlighted in a public lecture by Professor Jo Delahunty QC at Gresham College, an institution with a tradition of providing free public lectures dating back to 1597.
