Why the American legal system struggles to practice the mercy it already possesses

Martha Minow: How forgiveness can create a more just legal system · 14:47 · Video: TED · Watch at the source

In short: The United States possesses powerful legal tools for forgiveness, from pardons to bankruptcy laws. Yet, Harvard Law professor Martha Minow argues these mechanisms are applied inconsistently, often reinforcing existing racial and economic inequalities rather than providing the fresh starts they were designed to facilitate.

In her book, "When Should Law Forgive?", Martha Minow defines forgiveness as the act of letting go of justified resentment. While the U.S. legal system contains built-in techniques for mercy, Minow argues that the current criminal justice process is among the most punitive in history, characterized by the highest per capita incarceration rates in the world. This punitive shift is driven by a decentralized system where elected prosecutors often find it politically easier to campaign on longer sentences and increased imprisonment than on leniency.

The application of these forgiving tools is deeply tied to systemic inequality. Minow notes that racial division and oppression have historically shaped the criminal justice system, leading to significant discrepancies in incarceration rates and sentencing. Furthermore, the way the law handles debt reveals a profound power imbalance. While the U.S. Constitution empowers Congress to enact national bankruptcy laws—a priority for figures like Thomas Jefferson, who believed one generation should not be burdened by the debts of the previous one—the modern application favors corporations over individuals.

This disparity is evident in how the law treats different types of debt. For example, while a for-profit school can utilize bankruptcy to discharge its obligations, students who took out loans to attend that institution are unable to use bankruptcy to expunge their student debt. Minow suggests that moving toward a system of restorative justice, which prioritizes accountability and reconciliation over pure punishment, could help address these fundamental unfairnesses.
