The unique territory that belongs to two nations at once
In short: In north-eastern Bosnia and Herzegovina, a small administrative unit exists in a legal state of limbo. Known as a condominium, the Brčko District is simultaneously part of two different entities, functioning as a self-governing piece of land that defies standard borders.
The Brčko District was established in 1999 following an intense arbitration process led by the High Representative for Bosnia and Herzegovina. While the Dayton Peace Accords had finalized much of the country's post-war borders, the status of Brčko remained unresolved. The final agreement, reached in March 1999, created a unique administrative unit that covers the entire former Brčko municipality. This territory was originally split, with 52% lying within the Federation of Bosnia and Herzegovina and 48% within the Republika Srpska.
To manage this sensitive, multi-ethnic area, the district was structured as a condominium of both entities. For years, it was overseen by an American Brčko International Supervisor, a role first occupied in April 1997 by officials like Randolph Hampton. This period turned the district into a hub for international state-building programs, supported by agencies such as USAID and ECHO. In 2006, a significant legal shift occurred when Supervisor Susan Johnson issued a ruling that abolished all entity-level legislation and the Inter-Entity Boundary Line within the district, making local and state laws paramount.
Today, the district represents just 1% of Bosnia and Herzegovina's total land area, yet it houses 2.37% of the nation's population. Although the mandate of the International Supervisor was suspended following a May 2012 Peace Implementation Council meeting, the Brčko Arbitral Tribunal remains active. While the government of Republika Srpska resumed operations in the area in 2012, the district's autonomous status is protected; altering its fundamental structure would require a difficult change to the national constitution.
