The global patchwork of laws governing the face veil
In short: From secular mandates to security concerns, 24 states across three continents have moved to ban the burqa and niqab. While some nations cite a shared sense of public identity, others frame the restrictions as tools for educational empowerment or safety. The legal landscape is far from uniform.
The legislative approach to face-covering garments varies significantly by region and intent. In Europe, several countries have implemented comprehensive bans based on diverse justifications. Austria adopted a legal ban in 2017, while Belgium's 2015 ban was upheld by the European Court of Human Rights in 2017. Bulgaria enacted its ban in 2016 primarily due to security concerns; however, this sparked conflict as 10 percent of the population identifies as Muslim. In Denmark, a law passed in 2018 allows face coverings only for "creditable purposes" like sports or protection against cold, with fines reaching up to 10,000 kroner for repeat offenses.
France presents a complex case study in secularism (laïcité). While the 1905 law prohibits public servants from wearing religious symbols, specific face-covering bans have been contested.
Recent developments show shifting political tides. Italy's government approved a ban on niqabs and burqas across all public areas during October 2025, intending to focus on schools next. Portugal enacted a law in August 2026 allowing fines up to €3000 for face veils worn for religious reasons. Conversely, some local bans have been overturned; in Sweden, the Supreme Administrative Court ruled in 2022 that municipal bans on headscarves and niqabs in schools were unconstitutional because they lacked sufficient national legal support.
Even within Muslim-majority regions, restrictions occur. In July 2024, the Muftiate of Dagestan temporarily banned the niqab following attacks where an individual reportedly used it as a disguise.
