A 1971 court case redefined how we protect the environment
In short: Before the 1970s, regulators didn't always have to study the environmental impact of a project unless someone specifically sued them. The construction of the Calvert Cliffs Nuclear Power Plant changed that forever, establishing a legal precedent that forced the government to investigate ecological consequences proactively.
During this period, scientists at Johns Hopkins University raised alarms that the plant's discharge of heated cooling water could devastate the Chesapeake Bay ecosystem, specifically threatening the population of blue crabs. Such worries triggered a lawsuit that moved into American territory. The D.C. Circuit Court of Appeals. Circuit.
The resulting 1971 court decision was a pivotal shift in governance. It ruled that regulators were required to investigate the environmental consequences of a project regardless of whether a formal challenge had been filed. This interpretation of new environmental regulations ensured that the Atomic Energy Commission (and later the NRC) had to account for ecological impacts—like water temperature and wildlife safety—as a standard part of the approval process.
Today, the plant operates as a saturated steam facility owned by Constellation Energy. It utilizes an open-cycle heat dissipation system, pumping bay water through condensers at a rate of 1.2 million gallons per minute per unit. To lessen ecological damage, the bay receives water with a temperature rise of at most 12 °F from its initial state. This balance between industrial output and ecological preservation remains a core legacy of that 1971 ruling.
The plant's history is also marked by technical milestones, such as Unit 2 achieving a world-record capacity factor of 101.37 percent in 2008. While plans for a third reactor (CCNPP 3) were proposed to meet regional power needs, the project faced significant hurdles, including a 2010 impasse over federal loan guarantees and a 2011 NRC ruling regarding ownership requirements.
