In short: If California functioned as an independent country, its lengthy constitution might place it as the world's second or third most extensive. This legal behemoth is the result of a unique democratic mechanism that allows the public to bypass the legislature and rewrite the state's foundational laws directly.

The current California Constitution was ratified in 1879, following a series of drafts by pioneers and Californios after the Mexican–American War. While it serves as the primary organizing law for the state, its sheer size is a modern phenomenon. By 1962, the document had already reached 75,000 words, making it longer than any other state constitution at the time. Today, it is characterized by political scientists as a collection of incoherent policies and irrelevant details, largely because it is amended an average of five times every year.

The primary driver of this growth is the ballot initiative. While most states differ, California residents can initiate constitutional changes by collecting signatures matching 8% of the previous gubernatorial election's total votes. In 2023, this required 874,641 signatures. This low threshold, combined with a lack of faith in elected officials, has allowed the public to frequently insert specific mandates into the constitution. For example, many amendments were designed specifically to insulate state agencies—like the State Bar of California—from judicial oversight by authorizing their creation directly within the constitutional text.

Despite its bloat, the constitution contains unique protections that often exceed federal standards. It provides a stronger prohibition against 'cruel or unusual punishment' than the U.S. Eighth Amendment and was the first in the nation to constitutionally guarantee women equal rights in business and professions. It also grants 'home rule' powers to cities, allowing local laws to trump state law in certain municipal affairs. While the state attempted a massive 12-year revision process between 1964 and 1976 to strip out 40,000 words, the ongoing cycle of ballot propositions continues to expand the document's reach.
