Why a medical cannabis prescription might not protect your job
In short: Even with legal paperwork, a positive THC test can lead to termination. While advocates fight to treat cannabis like any other prescription drug, many employers still hold the power to fire patients, and current testing technology often lacks the nuance to distinguish between impairment and legal use.
The central tension in medical cannabis use lies in the gap between legal status and employment rights. In many states where medical cannabis is legal, employers are under no obligation to continue employing patients. In some jurisdictions, being a medical cannabis patient is sufficient grounds for dismissal. This creates a precarious situation for those using the plant for health reasons, particularly because THC—the primary psychoactive component of cannabis—can remain in the system for a very long time.
The difficulty is compounded by the limitations of modern drug testing. Standard urine tests can detect THC even if the user has only applied topical products to their skin. Furthermore, roadside drug tests currently lack the technology to determine the specific concentration of cannabis in a person's system. This means officers cannot definitively prove how much THC is present or whether it has caused actual impairment.
Advocates are currently pushing for a shift in how cannabis is treated, arguing it should be regulated similarly to other prescription medications, such as opiates. The goal is to ensure patients have the same protections as those using other controlled substances. Until these legal protections are standardized, some individuals even turn to much lower-THC alternatives, like Marinol, to provide a verifiable reason for THC presence in their system, as employers cannot distinguish between the two.
