Turning a spark of inspiration into a protected legal asset

What to do after you come up with an invention idea · 10:57 · Video: inventRightTV · Watch at the source

In short: Most people assume a great idea is enough to launch a product. In reality, an idea without a strategy is easily co-opted. To move from a mental concept to a tangible invention, you must navigate a complex landscape of education, legal protection, and international rights.

The journey from concept to commercialization begins with self-education. Many inventors find the process isolating, but success often depends on understanding the specific mechanics of the invention industry. This includes seeking mentorship and accountability to navigate the transition from a thought to a physical product.

A critical step in securing an invention is the patent. A patent serves as a legal registration, granting the owner the right to take action against anyone who manufactures, sells, or imports the invention without permission. In the UK, for instance, a patent can last for up to 20 years, provided it is renewed annually. However, protection is often geographically limited; a UK patent does not prevent others from using the invention in other countries.

Inventors seeking wider coverage may submit applications via the World Intellectual Property Organisation (WIPO) or the European Patent Office (EPO). These bodies allow for simultaneous protection in multiple regions. It is important to note that patents are not universal; they are specific to the jurisdiction where they are filed.

Not every idea qualifies for protection. To be patentable, an invention must be new—meaning it has not been publicly available anywhere in the world—and inventive, meaning it is not an obvious modification of existing technology. Conversely, certain categories are strictly excluded from patenting, such as artistic works, mathematical methods, discoveries, or software with non-technical purposes. Only software with a specific technical purpose may be granted a patent.
