Turning an idea into a protected asset requires more than creativity
In short: The transition from maker to inventor involves moving beyond the workshop and into the realm of legal protection. While making things is a powerful way to change the world, securing your intellectual property ensures that your unique contributions remain yours alone as you bring them to market.
Becoming an inventor begins with a shift in mindset: choosing to create rather than merely critique. For many, this journey starts with inspiration—such as observing complex engineering like jet engines—and culminates in the completion of a tangible project. However, for an invention to move from a personal project to a viable product, it must meet specific legal criteria regarding novelty and inventiveness.
To be patentable, an invention must be entirely new and not publicly available anywhere in the world. It must also be 'inventive,' meaning it cannot be an obvious modification of an existing product or process. This applies to physical objects, technical processes, and methods of doing things. Conversely, certain categories are strictly excluded from patent protection, including artistic works, business methods, scientific theories, mathematical methods, and software that lacks a specific technical purpose.
Securing a patent provides the legal right to take action against anyone who manufactures, sells, or imports your invention without permission. In the UK, these rights can last up to 20 years, provided they are renewed annually. It is crucial to understand that protection is often territorial; a UK patent does not automatically grant rights in other countries. Global protection requires inventors to liaise with entities such as WIPO or the European Patent Office (EPO).
The application process has specific requirements based on age and ownership. Individuals or groups can apply, but those under 18 are advised to seek legal counsel because they typically cannot enter into legal contracts for permission. Furthermore, applicants must be aware that their names and addresses will be published online as part of the public record.
