How a YouTube comedy duo became the unlikely architects of fair use law
In short: When Ethan and Hila Klein were sued for copyright infringement in 2016, they didn't just defend their channel. They helped establish a legal precedent that now shapes how creators across the internet use existing content for commentary and criticism.
Launched in 2016, the h3h3Productions channel, hosted by the American and Israeli duo Ethan and Hila Klein, built a reputation through a unique blend of reaction videos and absurd sketches. Their style, reminiscent of the comedy duo Tim & Eric, utilizes abrupt cuts and layered effects to satirize internet trends and personalities. While their content often critiques online gambling in games like Counter-Strike: Global Offensive, their most significant impact may lie in the courtroom.
In April 2016, Matt Hosseinzadeh, known as MattHossZone, filed a civil action against the Kleins, alleging they used over 70% of his work without substantive contribution. The ensuing legal battle became a landmark moment for digital creators. U.S. District Judge Katherine B. Forrest eventually ruled in favor of the Kleins, declaring their commentary constituted 'quintessential comment and criticism' and established that their use was fair use as a matter of law. This judgment provided a persuasive argument for future copyright disputes on the platform.
The channel's history is marked by ongoing friction with both media and other creators. In 2017, the Kleins supported PewDiePie during a controversy involving The Wall Street Journal's reporting on offensive jokes. Later, they faced defamation lawsuits from Triller co-founder Ryan Kavanaugh, which they framed as an attempt to suppress free speech. Even as recently as 2026, legal battles continued regarding Twitch streamers like Denims, where a judge ruled that certain livestream reactions also constituted fair use, citing the very precedents the Kleins helped build.
