How a two-thirds majority decides the fate of Kosovo's head of state
In short: In Kosovo, the presidency is not decided by a popular vote, but through a complex parliamentary dance. From secret ballots to contested elections, the process reveals the intricate constitutional mechanisms used to maintain the stability of this partially recognized republic.
The President of the Republic of Kosovo serves a five-undermined term of five years, which is renewable only once. Unlike many modern democracies, the leader is not chosen by the public but is elected indirectly by the parliament. This process requires a significant consensus: a candidate must secure a two-thirds majority of deputies in office through a secret ballot. If no one reaches this threshold, a third round of voting is held, where a simple majority is sufficient to decide the winner.
The powers of the office are extensive, ranging from the domestic to the international. The President acts as the Commander-in-Chief of the Kosovo Security Force and is responsible for the constitutional functioning of the nation's institutions. Key duties include promulgating laws approved by the Assembly, appointing the Prime Minister, and signing international agreements. The President also holds a unique check on legislative power, possessing the right to return adopted laws for reconsideration if they are deemed harmful to the interests of the Republic or its communities.
The history of the presidency has seen periods of significant legal friction. In February 2011, the election of Behgjet Pacolli was quickly criticized as unconstitutional, leading to his resignation just months later in April 2011. This instability necessitated temporary leadership, such as the role of the Speaker of the Assembly acting as President for no more than six months. To address these structural challenges, a constitutional reform was planned for 2013 to move toward a popular vote for the presidency.
