The Prime Minister's office was never actually created by law
In short: For centuries, the title of Prime Minister was a mere courtesy, used satirically by writers like Jonathan Swift. There is no founding document defining the role's powers, unlike the US presidency. Instead, the office emerged through a series of historical accidents and unofficial traditions.
The evolution of the British premiership is a study in constitutional improvisation. Unlike the structured presidencies of France or the United States, the office of Prime Minister lacks a formal charter setting out its specific duties. Even the title itself lacked official standing for much of its history; it was used satirically during Queen Anne's reign, and Robert Walpole, often cited as the first person to hold the role, denied having any unique authority beyond that of the King's other advisors.
Official recognition arrived much later than one might expect. The term did not appear in an official document until 1878, within the preamble to the Treaty of Berlin, which identified Disraeli as both the First Lord of the Treasury and the Prime Minister. It was not until December 1905 that a royal warrant from Edward VII formally granted the office precedence over the Archbishop of York. Consequently, Sir Henry Campbell-Bannerman holds the distinction of being the first individual to be officially appointed to the role.
Although significant, the position's legal status was not formally established until the 1937 Ministers of the Crown Act, where it appeared merely in passing. Professor Vernon Bogdanor, in his work based on lectures delivered at Gresham College in 2006 and 2007, examines this transition through the lens of eleven post-war leaders, from Clement Attlee to Tony Blair, exploring how these figures moved beyond mere administration to steer the nation toward specific ideological goals.
