The Marañón River is a legal person with fundamental rights to ecological health.
In short: Flowing from the high Andes to the Amazon basin, the Marañón River is more than a waterway; it is a contested source of the Amazon and a site of intense environmental struggle. In 2024, a landmark court ruling granted the river legal personhood, protecting its right to flow and remain unpolluted.
The Marañón River originates in the high Andes, roughly 160 km northeast of Lima, Peru. Historically identified as the primary source of the Amazon, its status is supported by its high annual discharge rates, though other rivers like the Apurimac and Mantaro also claim the title. The river’s geography is dramatic, featuring a section known as the 'Grand Canyon of the Amazon'—a 552-km stretch with canyon walls reaching 3,000 meters in depth, significantly deeper than the Grand Canyon in the United States.
The river’s midcourse is defined by 'pongos,' or deep, narrow gorges characterized by treacherous rapids. The most famous, the Pongo de Manseriche, is a 5-km-long rent in the Andes where the river narrows to just 30 meters and surges at speeds of 20 km/h. These features have long challenged explorers; while early figures like Charles Marie de La Condamine documented the river in 1743, the region remains a rugged, often dangerous frontier for modern kayakers and rafters.
Today, the Marañón is at the center of a conflict between development and conservation. Plans for up to 20 hydroelectric mega-dams have sparked fierce opposition from residents and environmental groups, who fear the projects will disrupt silt deposition, destroy aquatic habitats, and displace thousands. This tension culminated in a March 2024 ruling by a Peruvian court, which recognized the river as a legal entity. Initiated by Mari Luz Canaquiri Murayari, the decision establishes that the river possesses fundamental rights, including the right to exist and remain free from pollution, marking a significant shift in how the nation manages its natural resources.
