The rise of the generational ban on smoking
In short: Governments are moving beyond simple age limits to create entire generations of non-smokers. By banning tobacco sales based on birth dates rather than current ages, some nations are attempting to structurally engineer a smoke-free future for their youth.
While most countries regulate tobacco and cannabis through standard minimum purchase ages—often aligned with the age of majority or drinking laws—a new legislative trend is emerging. This shift moves from 'age of purchase' to 'generational bans.' These policies prohibit the sale of tobacco products to individuals born after a specific date, effectively creating a legal wall between generations.
The Maldives recently became the first country in the world to implement such a ban with a 2025 law. This legislation prohibits the sale, purchase, and use of tobacco for anyone born on or after January 1, 2007. Similar efforts have seen mixed success elsewhere: Australia proposed a ban for those born after 2000 in 2014 without success, while New Zealand passed a 2022 law targeting those born after 2009 but repealed it in 2024 before enforcement began.
The United Kingdom is set to join this trend with the Tobacco and Vapes Act 2026. Research suggests these higher age limits are most effective when integrated into broader tobacco-control measures, showing a correlation with lower smoking prevalence among those aged 11 to 20.
Complexity arises in multi-substance regulation. In some regions, the legal age for cannabis is higher than for tobacco. For instance, in three Canadian provinces and two territories, the tobacco purchase age remains lower than the cannabis age, while Prince Edward Island is an outlier where it is higher. To combat illegal sales regardless of age limits, experts emphasize that active enforcement, such as mystery shopping, is more effective than simply providing retailers with information.
