In short: Between January 2025 and January 2026, TikTok faced a de jure nationwide ban in the United States. While the law mandated a divestment from its Chinese parent company, ByteDance, the ban remained unenforced through a series of executive delays until the platform’s U.S. operations were finally sold and restructured.

The legal saga began with the Protecting Americans from Foreign Adversary Controlled Applications Act, which set a firm deadline for ByteDance to sell TikTok or face a total shutdown. Although the Supreme Court upheld the law, the transition was marked by political maneuvering. On January 18, 2025, TikTok voluntarily suspended services, only to have them restored the following day after President-elect Donald Trump signaled his intent to grant extensions. Upon taking office, Trump issued multiple executive orders delaying enforcement, eventually pushing the deadline to January 22, 2026.

These delays allowed for a complex corporate restructuring. On January 22, 2026, the deal closed, resulting in the divestiture of TikTok’s U.S. activities into a newly incorporated entity, TikTok USDS. This move effectively ended the period of the de jure ban. The entire process was driven by long-standing concerns regarding data privacy and national security, specifically the potential for user data to be accessed by the Chinese government under the China Internet Security Law.

Long before the 2025 ban, the platform faced mounting scrutiny. As early as 2019, the Peterson Institute for International Economics flagged the app as a national security threat, and by December 2019, the U.S. Navy and Army had prohibited the app on government devices. While TikTok consistently maintained that American user data was stored outside of China, reports in 2022 revealed that Beijing-based engineers could access private information. These revelations shifted the political landscape, leading many lawmakers who once questioned the necessity of a ban to eventually support the government's intervention.
