In short: Many people believe they need to register their art or pay a fee to secure legal protection. In reality, copyright is an automatic right. From software code to photographs, the law grants you exclusive control over how others use, share, or perform your original creations from the second of inception.

Copyright serves as a legal barrier that prevents unauthorized usage of your intellectual property. It specifically prohibits others from copying, distributing, renting, lending, or performing your work in public without permission. This protection extends to various mediums, including original literary, dramatic, musical, and artistic works—such as illustrations and photography—as well as non-literary content like software, web content, and databases. These protections also encompass television and film recordings as well as various broadcasts. Additionally, the specific layout of published editions for musical or dramatic works is covered.

A common misconception is that a copyright symbol (©), a name, or a specific year of creation is required to establish ownership. While you can include these markings on your work for clarity, they do not affect the actual level of protection provided by law. Furthermore, unlike trademarks—such as Mattel's registered 'Magic 8 Ball'—there is no official register of copyright works in the UK; the protection exists inherently upon creation. Because there is no official register, you do not have to pay any fees or submit an application to gain these rights. This distinguishes copyright from other forms of intellectual property like registered trademarks.

The duration of these rights varies depending on the medium and jurisdiction. Under international agreements like the Berne Convention, most countries ensure that written, dramatic, and artistic works are protected for at least 50 years after the creator's death. Photographs typically receive a minimum of 25 years of protection. These rules ensure that creators maintain control over their legacy while providing a framework for how work can be licensed or sold globally. The specific length of protection can vary significantly depending on the category of work produced. For instance, some types of content may have different rules than standard artistic pieces. This framework allows creators to manage how their property is licensed or sold.
