In short: British singer-songwriter Kirsty MacColl died in 2000 while diving in a restricted area off the coast of Mexico. She was struck by a speeding powerboat while saving her son. The subsequent legal battle, involving a wealthy businessman and a scapegoated employee, sparked a long-running international campaign for accountability.

On 18 December 2000, Kirsty MacColl was vacationing in Cozumel, Mexico, with her two sons and boyfriend. While surfacing from a dive at the Chankanaab reef, she spotted a powerboat entering a restricted zone where watercraft were prohibited. MacColl successfully pushed her 15-year-old son, Jamie, out of the vessel's path, but she was struck and killed instantly at age 41.

The boat was owned by Carlos González Nova, founder of the Comercial Mexicana supermarket chain, and was being operated by his brother Guillermo González Nova's employee, José Cen Yam. Although eyewitnesses reported that the boat was traveling at high speed and that Cen Yam was not at the controls, Cen Yam claimed responsibility. He was found guilty of culpable homicide and sentenced to less than three years in prison, a term he avoided by paying a fine of 1,034 pesos, roughly equivalent to 63 euros at the time.

MacColl's family launched the Justice for Kirsty campaign, alleging that the true driver was shielded from prosecution due to his immense wealth. The campaign pursued legal avenues, including applications to the Inter-American Commission on Human Rights, and criticized the Mexican authorities for their lack of cooperation. In 2006, a federal prosecutor was found liable for breach of authority regarding the case. The campaign officially concluded in 2009, having achieved most of its objectives, with remaining funds donated to charity.

Beyond the tragedy, MacColl remains celebrated for her musical legacy, including her iconic duet on The Pogues' 'Fairytale of New York' and her critically acclaimed final album, Tropical Brainstorm. A memorial bench in London's Soho Square, inscribed with a lyric from her song 'Soho Square', serves as a site for fans to gather annually on her birthday, 10 October, to honor her life and work.
