In short: Before the title of Chief Minister existed, it was held by a Prime Minister. A constitutional amendment in 1965 fundamentally altered how the region's executive authority is structured, moving away from its princely roots toward a modern administrative framework within the Indian Union.

The transition to the office of Chief Minister was formalized through the 6th amendment to the state's constitution, which took effect on June 6, 1965. The designation of Prime Minister for Jammu and Kashmir was removed by this particular legislative modification. Following this reorganization, Ghulam Mohammed Sadiq became the first individual to be sworn in as the Chief Minister of the state. This change occurred after a period when the region was governed by various prime ministers. The previous title of Prime Minister had been in use since at least 1947.

The role operates under a distinct power dynamic within the current Union Territory framework. While the lieutenant governor is the de jure head of government, the chief minister holds the de facto executive authority. The process for selecting this leader involves the lieutenant governor inviting the party or coalition with a majority of seats in the Legislative Assembly to form the government. The chief minister is appointed directly by the lieutenant governor. This leader also oversees a council of ministers who must answer to the assembly.

The history of the office is marked by significant administrative shifts. After the state was reorganized into a union territory on October 31, 2019, president's rule was eventually discharged via the lieutenant governor. This structure remained in place until a new chief minister was established following the 2024 Jammu and Kashmir Legislative Assembly election. A period of governor's rule occurred between June and December 2018. The office remained vacant for several years before the recent elections.

A chief minister serves a five-year term and is collectively responsible to the assembly along with their council of ministers. The role also carries the responsibility of serving as Leader of the House in the Legislative Assembly, ensuring that executive actions align with constitutional mandates. The official must take a solemn oath to uphold India's sovereignty and integrity. They also swear to keep all government secrets confidential.
