How a satiric duck creator fought Marvel for his intellectual property rights in court.
In short: Steve Gerber, the visionary behind Marvel's Howard the Duck, was a master of subverting comic book tropes. Beyond his satirical wit, his career was defined by a landmark legal battle over character ownership, a relentless pursuit of creative independence, and a prolific output that spanned comics, animation, and television.
Born in 1947, Steve Gerber began his career as a copywriter before joining Marvel Comics in 1972. He quickly gained a reputation for unconventional storytelling, famously inserting lengthy text pages into his narratives and creating the empathic swamp-monster Man-Thing. His most iconic creation, Howard the Duck, debuted in 1973 and became a cult phenomenon, even launching a satirical presidential campaign in 1976.
Gerber’s relationship with Marvel soured in the late 1970s, leading to his firing in 1978 amid disputes over chronic tardiness and creative control. In 1980, he initiated a high-profile copyright lawsuit against Marvel’s parent company, Cadence Industries, asserting he was the sole owner of Howard the Duck. To fund this legal challenge, he collaborated with Jack Kirby on the satirical comic Destroyer Duck. The case concluded in 1982 with a settlement in which Gerber acknowledged the work was created as a work-for-hire, confirming Marvel's ownership.
Despite these conflicts, Gerber remained a force in the industry. He contributed to DC Comics, worked on animation projects like The Transformers and G.I. Joe, and shared a 1998 Daytime Emmy Award for his work on The New Batman/Superman Adventures. Even while battling idiopathic pulmonary fibrosis in his final years, he continued writing for DC’s Countdown to Mystery. Gerber passed away in 2008, leaving behind a legacy of satirical brilliance and a complex history of fighting for creator rights in a corporate-dominated medium.
