This period saw a frantic rotation of leadership: Menas was rehired and then resigned within 18 days; Pete Porcelli coached a single game before being fired the next night; and Terry Foster declined a coaching offer after Brown fired an associate over a restaurant's unpaid food bill. The instability peaked when the NAL terminated the Empire’s membership on June 15, 2023, due to unpaid league operating costs and fines. While some attributed the downfall to Brown's erratic management, arena officials pointed to structural economic hurdles. General Manager Bob Belber noted that New York’s high worker’s compensation premiums cost the team $1,500,000 in 2023—roughly 15 times higher than other arena teams. This financial pressure eventually led to a pivot; while the Empire assets remain as an alternate brand, the ownership group moved to revive the Albany Firebirds in the relaunched Arena Football League.
