In short: While the world watched the smoke rise from Lower Manhattan, a Polish immigrant named Henryk Siwiak was walking toward a job in Brooklyn. He was shot and killed in a neighborhood the police feared was a flashpoint for violence. His death remains a haunting footnote to the day's tragedy.

Henryk Siwiak, a native of Kraków, arrived in New York City to find work after being laid off from the Polish State Railways. On the night of September 11, 2001, he sought a cleaning job at a supermarket in the Bedford–Stuyvesant neighborhood. Because the city does not include the victims of the terrorist attacks in its official crime statistics, Siwiak’s death is technically the only homicide recorded in New York City on that date.

The investigation into Siwiak's death was severely hampered by the massive diversion of law enforcement resources to respond to the attacks. The NYPD could not deploy its standard Crime Scene Unit; instead, they used an evidence-collection unit typically reserved for nonviolent property crimes like burglaries. Furthermore, while a homicide normally might see nine detectives canvassing a neighborhood, only three were available to investigate Siwiak's death.

Detectives have long speculated that Siwiak's appearance may have contributed to his fate. He wore a camouflage jacket and pants, spoke with a heavy accent, and possessed poor English. His sister, Lucyna, suggested that in a climate of high anxiety and anger, a passerby may have mistaken him for a terrorist. Despite these theories, the case remains cold. Siwiak was found with $75 in his wallet, leading investigators to believe the motive was either a botched robbery or a tragic misunderstanding.

Siwiak's death highlights the logistical strain of major crises on local safety. Because of the sheer scale of the 9/11 attacks, his murder received minimal media attention for weeks, and the lack of witnesses on a dangerous corner has left the case unsolved. To this day, his widow and sister maintain that the truth may be lost forever in the shadow of the day's larger events.
