The fatal error of a police officer who entered the wrong apartment at night
In short: On September 6, 2018, off-duty officer Amber Guyger entered an apartment she mistakenly believed was her own, fatally shooting 26-year-old accountant Botham Jean. The incident, marked by ignored visual cues and a failure to follow police protocols, ignited national debates regarding racial bias, police accountability, and the use of force.
Amber Guyger, a 30-year-old Dallas Police Department officer, returned home after a 13.5-hour shift on September 6, 2018. She parked in the fourth-floor garage of the South Side Flats and walked to apartment 1478, believing it was her own unit, 1378, located directly below. Despite the presence of a distinctive red doormat and the absence of a large planter—visual indicators that she was on the wrong floor—Guyger entered the apartment, which had a defective electronic lock that failed to latch. Inside, she found Botham Jean, an unarmed accountant, sitting in his living room. Guyger fired twice, striking Jean in the chest.
The legal proceedings that followed were complex and highly scrutinized. Initially charged with manslaughter, Guyger was later indicted for murder. Prosecutors argued that her actions were not the result of exhaustion but a failure to follow standard police protocols, such as calling for backup from the nearby station. In October 2019, a jury found her guilty of murder, and she was sentenced to ten years in prison. Her conviction was upheld on appeal in 2021. In a separate 2024 wrongful death lawsuit, a jury ordered Guyger to pay $98.65 million to Jean's family, though the family acknowledged they are unlikely to collect the full amount.
The case prompted significant legislative and cultural shifts. Controversy erupted over the conduct of police leadership, specifically regarding the disabling of an in-car camera during the immediate aftermath of the shooting. This led to the passage of the Botham Jean Act in September 2021, which prohibits officers from disabling body cameras during active investigations. Furthermore, the Dallas City Council renamed a portion of South Lamar Street to Botham Jean Boulevard in 2021. The case remains a landmark in American discourse on police conduct, as Guyger was the first Dallas officer convicted of murder since 1973.
