The £20 million legal odyssey of a football transfer
In short: When Ricky Álvarez moved from Inter Milan to Sunderland, it triggered a marathon of litigation that cost the English club over £20 million. What began as a standard loan-to-buy agreement devolved into a complex battle over medical disclosures, hidden surgeries, and international arbitration.
In 2014, Sunderland signed Argentine playmaker Ricky Álvarez on loan from Inter Milan. The deal included a conditional obligation to purchase him for €10.5 million if Sunderland avoided relegation. However, the move became a legal quagmire when Álvarez suffered a right knee injury shortly after arriving in England. Sunderland refused to trigger the purchase, claiming Inter had failed to disclose a previous micro-surgical repair on the player's knee and had blocked Sunderland's requests for further surgery.
The dispute escalated into a multi-year legal battle involving the Court of Arbitration for Sport (CAS) and FIFA. Sunderland were ordered by the CAS in 2017 to settle the transfer cost to Inter, as the tribunal dismissed claims that hidden health problems cancelled the agreement. While the transfer was technically completed, Álvarez never signed a new contract with Sunderland, leaving him as a de facto free agent. This resulted in a bizarre situation where Sunderland were forced to pay the fee but could not recoup it when Álvarez later signed with Sampdoria.
The financial fallout was staggering. By 2019, a FIFA tribunal ordered Sunderland to pay Vélez Sársfield €362,500 in solidarity fees. Additionally, Álvarez won a personal appeal in 2021, awarding him £4,770,000 in lost earnings. Sunderland's total costs for the deal exceeded £20 million, leading the club to attempt a £13 million lawsuit against the club doctor who performed the initial medical—a suit that was eventually dropped in 2021.
Álvarez, a technically gifted playmaker often compared to Kaká for his elegant style, remains a symbol of the high-stakes risks in modern football. His career, which included reaching the 2014 World Cup Final with Argentina, serves as a cautionary tale of how a single medical disagreement can spiral into a decade of litigation.
