In short: After Nazi Germany collapsed, the Allies faced a unique legal dilemma: how do you govern a country whose government has vanished? They created the Allied Control Council, a joint authority designed to prevent any future regime from claiming legitimacy while navigating the friction of four competing superpowers.

The Allied Control Council (ACC) was established in 1945 as the sole legal sovereign authority for Germany and Austria following World War II. Its primary purpose was to manage the transition from Nazi rule to a postwar order, specifically focusing on demilitarization and denazification. While the country was split into four distinct occupation zones—each ruled by its own military commander-in-chief—the ACC served as the organ for decisions affecting Germany as a whole. This structure was first outlined in an 1944 London agreement and formalized during the Potsdam Agreement of August 1, 1945.

The council's existence was rooted in a desire to avoid historical repetition. Because Hitler had used the 'stab in the back' myth to claim that only the civilian government surrendered in 1918, the Allies were determined not to allow any future German administration to use similar arguments. To solve this, they signed the Berlin Declaration of 1945 on June 5, 1945. This document formally dissolved Nazi Germany and placed supreme authority in the hands of the four powers (the US, UK, France, and USSR), effectively legalizing their military rule over the entire nation.

However, the ACC was often more symbolic than functional. Because real power resided with individual military governors, many council resolutions were merely recommendations rather than binding laws. Cooperation began to fracture quickly over reparations and economic policy. A major turning point occurred in late 1945 when disagreements over war crimes trials led to Law no. 10, which allowed each power to run its own independent legal systems. This signaled the beginning of the end for inter-Allied cooperation, eventually leading to the Soviet withdrawal in 1948 and the division of Germany into two separate states.
